Myself and infant daughter were involved in a car accident when a girl text messaging re-ended us  on May 21, 2012. I was nine months pregnant at the time. Naturally I was more concerned with the safety of my infant and unborn child than suing the insured insurance company.
Because I was so overwhelmed with my two very young children, I did not immediately start building a case.
I naively thought the insurance company would "do right by me and my child."
I got a rude awakening when a year later, the insurance company offered me $500 and my medical bills paid.
BTW my son had to be induced early because of soft tissue damage from the accident and my daughter cried from neck pain for 2 weeks. I was in pain all over  my entire body from being slammed into when the girl that hit me was probably going at least 20 miles per hour. She never hit the brakes. It caused more than $10,000 in damages to my new car and took over a month to fix.
The insurance company offered ZERO for my daughter's pain and suffering, only enough money to pay medical bills.
I called around and many attorneys did not want to take my case. It was a less than 5 figure case and many do not want to take small cases

I got the $7,500 maximum in small claims and I was more than happy.
The whole time I really just expected that about 3 grand would make me happy. The insurance company tried to bully into walking away with pennies but they ended up paying more than double what I was asking for.
